By accessing and using Scrappa ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Description of Service

Scrappa provides API services that allow you to access data from various sources including Google Search, Maps, YouTube, Trustpilot, and other data providers. The Service is provided on a credit-based pricing model.

3. Account Registration

• You must provide accurate, current, and complete information during registration

• You are responsible for maintaining the security of your account credentials

• You are responsible for all activities that occur under your account

• You must be at least 18 years old to use the Service

• One person or entity may not maintain more than one account

4. Credits and Payment

4.1 Credit Packages

• Credits are purchased in advance through one-time purchases

• Credits expire 12 months after purchase

• Credits are consumed on a first-in-first-out (FIFO) basis

• All sales are final - credits are non-refundable except as required by law

4.2 Pricing

Pricing is displayed on our pricing page and may be updated from time to time. Changes to pricing will not affect credits already purchased.

4.3 Payment

• Payments are processed through secure third-party payment processors

• You agree to provide current, complete, and accurate purchase information

• You agree to pay all charges incurred by your account

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws

• Violate or infringe upon the rights of others

• Attempt to reverse engineer, decompile, or disassemble the Service

• Use automated systems to access the Service in a manner that sends more requests than a human could reasonably produce

• Interfere with or disrupt the Service or servers connected to the Service

• Resell or redistribute API responses without authorization

• Use the Service to scrape or collect data in violation of third-party terms of service

• Attempt to gain unauthorized access to any portion of the Service

6. Rate Limits

We reserve the right to implement rate limits to ensure fair usage and system stability. Rate limits may vary based on your account tier and usage patterns. Excessive usage may result in temporary or permanent suspension of your account.

7. API Availability

While we strive to maintain high availability, we do not guarantee that the Service will be available at all times. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from Service unavailability.

8. Data and Content

The data provided through our API is sourced from third parties. We do not guarantee the accuracy, completeness, or timeliness of the data. You are responsible for ensuring your use of the data complies with applicable laws and third-party terms of service.

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Scrappa and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without our express written permission.

10. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms of Service

• Engage in fraudulent or illegal activity

• Abuse the Service or other users

• Fail to pay any fees owed

Upon termination, your right to use the Service will immediately cease. Any unused credits will be forfeited unless otherwise required by law.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Scrappa SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Indemnification

You agree to indemnify and hold harmless Scrappa, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
